Probate is a legal process that classifies and gathers together the assets of a deceased person, the decedent. The Probate process can involve identifying , inventorying and appraising the deceased person’s property and paying off debts and taxes, as well as costs of the probate proceeding.  Probate administration includes the following:

  • proving in local court that a deceased person’s Will is valid
  • identifying , inventorying and appraising the deceased person’s property and paying off debts and taxes
  • distributing the remaining property as the will or state law directs

Every decedent’s estate in Florida must be administered through the probate process, even if there is a valid Will.
